Using this website
All text, design, illustrations and photos on this website, and the Bluform Creative name and logo, are protected by Danish copyright and trademark law. You're welcome to link to the site and share it, but please don't copy or reuse the content without written permission.
The work shown is presented as portfolio examples. Brand names, logos and trademarks belong to their owners, and photographers are credited where relevant. Some cases are concept or student projects. They are marked as such and weren't commissioned by the brand shown.
The information on the site is general and isn't an offer. I work to keep it correct and the site available, but can't guarantee that it's always error-free or online. I'm not responsible for the content of external websites that I link to.
1. Scope
These terms apply to all quotes, assignments and deliveries from Bluform Creative to business customers ("you"), unless we agree otherwise in writing. Your own purchasing terms only apply if I have accepted them in writing. If you are a consumer, mandatory Danish consumer protection rules apply and take precedence.
2. Quotes and agreement
A quote describes the scope, deliverables, number of feedback rounds, timeline and price. It is valid for 30 days unless it says otherwise. An agreement is made when you accept the quote in writing, for example by email.
A fixed price covers the scope described in the quote. Work on an hourly basis is invoiced for the time spent. An estimate is not a fixed price. If it looks like an estimate will be exceeded, I'll tell you as soon as possible and before the extra work is done.
3. Changes and extra work
Changes or extra work beyond the agreed scope or number of feedback rounds are agreed before I start on them and invoiced at the hourly rate in the quote.
4. Prices and expenses
Prices are in Danish kroner (DKK) and exclusive of VAT (moms) unless stated otherwise. Third-party costs, such as stock images, font licences, printing, software licences and travel, are agreed in advance and either invoiced at cost or bought directly by you.
5. Payment
Invoices are due 14 days net unless we agree otherwise. Larger or longer assignments can be invoiced in instalments, for example with a payment at the start, as stated in the quote.
If payment is late, interest and reminder fees are charged in line with the Danish Interest Act (renteloven). I may pause work and hold back final files until overdue invoices are paid.
6. Your part
- You provide material, feedback and approvals in time. Delays on your side may move the agreed deadlines.
- You guarantee that you have the rights to the material you give me (such as texts, logos, images and fonts), and you hold Bluform Creative harmless if a third party makes claims because of that material.
- You are responsible for the final proofreading and approval before anything is printed or published, and for making sure the content follows the rules that apply to you, such as marketing law and claims about products and prices.
- If you want a name or logo protected or registered as a trademark, the search and registration are your responsibility unless we agree otherwise.
7. Copyright and right of use
All work is protected by the Danish Copyright Act (ophavsretsloven). Copyright stays with Bluform Creative unless we agree otherwise in writing.
- When the invoice for the assignment has been paid in full, you get the right to use the final, approved deliverables for the purposes, media and markets agreed in the quote.
- For a logo or visual identity, you get an exclusive right to use the final, approved design without limits in time or media, including the right to have it adapted for your own use, unless we agree otherwise.
- Other use, such as new media, markets or periods, requires a separate agreement.
- Sketches, concepts that weren't chosen, and working files (for example open InDesign, Illustrator, After Effects or Figma files) remain the property of Bluform Creative and aren't included unless agreed.
- Elements from third parties, such as stock images and fonts, are covered by their own licence terms.
- My moral rights under the Copyright Act still apply, for example the right to be credited where it is customary.
8. Portfolio and confidentiality
I treat your confidential information as confidential and don't share unpublished work. Once the work has been published, I may show it in my portfolio, on this website and on social media, unless we agree otherwise.
9. Deadlines and delays
Agreed deadlines assume that I receive material and feedback on time. If I am delayed, I'll tell you as soon as possible and give you a new expected delivery date.
10. Cancellation
You can cancel an assignment in writing at any time. You then pay for the work done up to the cancellation and for costs already committed, such as licences. Rights to cancelled work are only transferred if the work is paid for. I can cancel the agreement if you materially breach it, for example by not paying.
11. Liability
Bluform Creative is liable under the general rules of Danish law, with these limits:
- I am not liable for indirect losses, such as lost profit, lost revenue or loss of data.
- My total liability is limited to the fee paid for the assignment in question.
- I am not liable for errors in material you have approved, or for errors made by third parties such as printers and production companies.
- Neither of us is liable for delays or failures caused by circumstances outside our control (force majeure).
12. Complaints
Please report any defects in a delivery as soon as possible and no later than 14 days after delivery. I'll then correct justified defects within a reasonable time.
13. Personal data
If I process personal data on your behalf as part of an assignment, we will make a data processing agreement. How I handle personal data otherwise is described in the privacy policy.
14. Law and disputes
These terms and our agreements are governed by Danish law. We'll try to solve any disagreement through dialogue first. If that isn't possible, the dispute is settled by the Copenhagen City Court (Københavns Byret) as the first instance.
15. Versions and language
The version of these terms that applies when the agreement is made is the one that counts. The terms are available in Danish and English with the same content. If there is any doubt, the Danish version applies.
